Exempt
from the primary criteria of being less than 50 years old
Legislative Instrument IMMI 12/058 [F2012L01284] Migration Regulations 1994 -
Specification under paragraphs 186.221(b), 186.231(b), 187.221(b) and
187.231(b) - Classes of Persons (Exempt from the Age Criteria) - June 2012,
commences on 1 July and specifies classes of persons exempt from having to
satisfy the primary criteria of being less than 50 years old at time of
application for a Subclass 186 or 187 (ENS/RSMS) visa in the new "Direct
Entry" or "Temporary Residence Transition" streams.
Class 1 is:
Ministers of Religion (ANZSCO 272211) nominated by religious institutions; Researchers, scientists and technical specialists at ANZSCO skill levels 1 or 2, nominated by Australian government agencies; and A senior academic to be employed at an Academic level of B, C, D or E as a University Lecturer (ANZSCO: 242111) or Faculty Head (ANZSCO: 134411) as nominated by a university in Australia.The Instrument also specifies the class of persons exempt from having to satisfy the primary criteria of being less than 50 years old at time of application for ENS/RSMS in the Temporary Residence Transition stream only.
Class 2 is:
Who have worked for their nominating employer as Subclass 457 holders for at least the four years immediately before application; and Whose annual earnings for each year in the four year period was at least equivalent to the Fair Work High Income Threshold ($123,300 annually from 1 July).Exempt

Specification under subclause 186.234(3) and paragraph 187.234(a) - Classes
of Persons (Exempt from the Skill Criteria) - June 2012, also
commences on 1 July, and specifies three classes of persons exempt from the
skill or qualifications criteria for ENS/RSMS.
Class 1 relates to ENS Direct Entry stream and subclause 186.234(3) of the Regulations and is:

Persons who are nominated for a position where their nominated earnings will be at least equivalent to the current Australian Tax Office top individual income tax rate.Class 3 also relates to the ENS Direct Entry stream and subclause 186.234(3) and the RSMS Direct Entry stream and paragraph 187.234(a) of the Regulations and is:
Persons who are currently in Australia as the holder of a Subclass 444 or 461 visa and have been working with their nominating employer in their nominated occupation for at least two of the last three years immediately before making their application (excluding periods of unpaid leave).
