I have a friend who own a 1960 rental property which is leased to a
tenant.
Recently, his tenant made
an asbestos assessment report on the
backyard the property and found the presence of asbestos
particles in the air, which theysuspect was due to a recent sewage repair/excavation
work done 3 months ago. My friend had quickly ordered an assessment and air
monitoring to be carried out.
My friend, as a landlord, would like to find out what kind of legal
implication, of this discovery have on him, given that he had no prior knowledge of any asbestos
risk when leasing out the property. Also, there has been no
mentioned of an asbestos clause in the leasing agreement prepared by his property agent.
